When police are called to a domestic disturbance, one of the parties will usually be arrested and removed from the residence. A judge will typically issue temporary restraining order under the Family Abuse Prevention Act. If children are involved, the court can also award the victim temporary custody of children.

I can help you obtain a restraining order if you are fearful for your own safety or your children, but I typically get involved after an assault has occurred. Domestic violence and restraining orders are commonly followed by a divorce or custody action, in which the two cases are consolidated in family court.

If the custody order is challenged, the noncustodial parent is entitled to a hearing that will be held within five days. Otherwise, a hearing will be held within 21 days on whether to grant a permanent restraining order. I represent either party or either parent in these proceedings:
